These Terms and Conditions apply to all purchases made through our webshop. By using our website and placing an order, you agree to the following terms and conditions.

  1. General Information

The website www.cocoymaria.com is owned by Cocoy Maria BV with registered office at Cellebroedersstraat 10 bus 3204, 2000 Antwerpen, België. Registered in the Crossroads Bank for Enterprises under the number: VAT: 1017.726.968 (hereinafter: “Seller”).

        2. Applicability:

These Terms and Conditions apply to all offers, orders, and agreements made on our webshop. Deviations are only valid if agreed upon in writing.

2. Products and Pricing

1. Product Descriptions:

We strive to provide accurate and detailed descriptions of our products. In case of errors, you have the right to cancel your order before shipment.

2. Pricing:

All prices listed are in Euro and include VAT but exclude shipping costs. Shipping costs are displayed during checkout.

3. Errors:

In the event of a pricing error, we reserve the right to cancel or amend your order after informing you.

3. Ordering and Contract Formation

1. Order Process:

• Select your products, add them to your cart, and complete the checkout process.

• By completing the payment, you agree to enter into a legally binding agreement.

2. Confirmation:

Once your order is placed, you will receive an email confirmation. This email serves as acknowledgment of your order but not as acceptance of your purchase.

3. Right to Refuse:

We reserve the right to refuse or cancel orders, for example, due to product unavailability, incorrect pricing, or suspicion of fraud.

4. Payment

1. Methods:

We currently rely on Mollie concerning payments and they cover almost all cerdit/debit cards like Visa, Mastercard, Bancontact/Mistercash, Maestro, KBC pay button, ING pay button

Payment data is handled securely in compliance with GDPR and PCI DSS standards.

  • Non-Payment:

If payment is not received, your order may be canceled. The Articles remain property of the Seller until paid for in full by the Buyer. 

5. Delivery

1. Shipping:

• We currently deliver to Europe

• Delivery times vary depending on the destination and are provided as an estimate only.

2. Delay:

If delivery is delayed, we will inform you promptly.

3. Risk:

The risk of loss or damage transfers to you upon delivery.

6. Right of Withdrawal

1. Cooling-Off Period:

As a consumer, you have the right to cancel your order within 14 calendar days of receiving your goods without providing any reason.

2. Exclusions:

The following items are not eligible for withdrawal:

• Custom-made or personalized items.

• Sealed items unsealed after delivery for hygiene reasons (e.g., cosmetics).

  • How to Exercise Your Right:

• Notify us via email or by using the Withdrawal Form (https://economie.fgov.be/sites/default/files/Files/Forms/Formulier-herroeping.pdf) or another unambiguous statement 

• Return the goods within 14 days of cancellation, at your expense.

4. Refunds:

Refunds will be processed within 14 days after receiving the returned unused goods. The original packaging will be checked and if there are no damages, the amount due will be transferred back to the Consumer in the same manner in which payment was made when the order was placed.

7. Warranty and Complaints

1. Warranty:

Products are covered by the statutory 2-year warranty under Belgian law. If the product is defective, please contact us promptly.

2. Complaints:

Complaints must be submitted via email to [email protected]  within 3 working days following receipt.

3. Disputes:

If we cannot resolve a complaint, you may refer it to the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.

8. Liability

1. Scope:

We are not liable for indirect damages, such as loss of profit or data, except in cases of intent or gross negligence.  The Seller is also not liable for any damage suffered by the Buyer or any third party as a result of the Buyer’s or any third party’s inability to use the Products properly.

2. Force Majeure:

We are not responsible for delays or non-performance caused by events beyond our control (e.g., natural disasters, strikes, war).

9. Privacy Policy

We value your privacy and process your personal data in compliance with the General Data Protection Regulation (GDPR). For details, please refer to our [Privacy Policy].

Some Further info

The Seller collects the following personal data from the Buyer in order to perform the contract with it: first and last name, country, street and house number, city, postal code, email address and, telephone number. These personal data are shared with third-party partners on which the Seller relies (CRM, sales, invoicing, accounting, general processing of documents, transport) and this, if applicable, outside the European Economic Area, with the necessary measures and safeguards being taken by the Seller to ensure appropriate protection of the personal data. These personal data will never be sold or passed on to third parties for commercial purposes. The personal data are kept as long as this is necessary for the execution of the agreement with the Buyer and until 7 years after the termination of the agreement. The Buyer has the right to request from the Seller the inspection, rectification or erasure of personal data or, in certain cases, the restriction of the processing on it, as well as the right to object to the processing and the right to data portability (the latter only for data provided by the Buyer himself). In addition, the Buyer may lodge a complaint with the Data Protection Authority (Drukpersstraat 35, 1000 Brussels, +32 2 274 48 00, [email protected]), but the Seller always requests to contact it first if, in the Buyer’s opinion, a problem should arise.

10. Applicable law and competent court  

  1. The sale of the Articles and these General Terms and Conditions of Sale are governed exclusively by Belgian law, to the exclusion of the 1980 Vienna Sales Convention. 
  2. If the agreement is concluded between the Consumer and the Seller, the court of the Consumer’s domicile shall have jurisdiction to settle the dispute. For other disputes, the court of Antwerp, Antwerp division shall have exclusive jurisdiction. 
  3. For Consumers, there is also the possibility of recourse to alternative dispute resolution through the Consumer Ombudsman Service (North Gate II, Koning Albert II-laan 8 Bus 1 1000 Brussels, tel : 02 702 52 00, [email protected], www.consumentenombudsdienst.be/nl). If you are a Consumer resident in a European country other than Belgium, we refer you to the European Commission’s online dispute resolution portal: https://ec.europa.eu/odr.

11. Changes to Terms and Conditions

We reserve the right to amend these Terms and Conditions. The version applicable to your order will be the one in effect at the time of purchase.
